After the U.S. Supreme Court’s decision in Haaland v. Brackeen last year, which addressed the constitutionality of the federal Indian Child Welfare Act (ICWA), we supported legislation to codify this important law for Indigenous autonomy and tribal jurisdiction into state law. Though SCOTUS upheld the law last year, we urged codification of its important protections for Indian children in the child welfare system to ensure that no adverse future rulings could erode its critical protections at the state level. This bill died in committee.
