This legislation would have placed even more stringent criminal record check requirements on Medicaid- funded personal care attendants than are currently required. This is troubling on its own, but we expressed further concerns that the legislation could have inappropriately barred an immediate family member from serving as a personal care attendant, and that it would have eliminated patient autonomy in making decisions about the individuals employed to provide care for them. We urged rejection of this legislation, which ultimately died in committee.
